TERMS OF FREE USE FOR UNAM OPEN DATA


By entering this portal of the National Autonomous University of Mexico (Universidad Nacional Autónoma de México, UNAM) and querying and utilizing the Open Data contained in it, you expressly accept the following:

Terms of Free Use for UNAM Open Data

These “Terms of free use” promote querying of digital university collections that are public and accessible on line, in due compliance with applicable law, including intellectual property law.

  1. You, as the “USER”, acknowledge that the Open Data contained herein are:
    1. Accessible: The data are available to the widest range of users, for any purpose;
    2. Freely usable: They cite the original source as the sole requirement to be used freely;
    3. Free of charge: Are obtained for no consideration whatsoever;
    4. Comprehensive: They contain the subject described in detail and the necessary metadata;
    5. Machine-readable: They shall be structured fully or in part to be processed and interpreted automatically by electronic equipment;
    6. Non discriminatory: The data are available to anyone without the need for registration;
    7. Timely: They are updated periodically, as they are produced;
    8. Permanent: They are preserved over time, for which purpose historical versions relevant to public use will be kept available through suitable institutional identifiers;
    9. Primary: They stem from the original source with the maximum disaggregation level possible.
  2. Every “USER” undertakes not to use the information to deceive or mislead the public by varying its original sense and veracity.
  3. The “USER” acknowledges that “UNAM” is inspired in the principles of freedom of teaching and research, and welcomes all schools of thought and scientific and social trends for the exclusive purpose of teaching and research. Therefore, under no circumstance shall the information be used by the “USER” purportedly to represent an official position of “UNAM” or that such use is backed, comprised, sponsored or supported by the original source.
  4. The “USER” undertakes to grant the corresponding credit to “UNAM” as the producing institution and, whenever possible, mention the University entity or school that collaborated in generating the information, specifying the date of most recent update, according to the following cases:

    2. In the event the information generated comes from querying more than one record within one collection, the citation should be as follows:

    3. In the event the information generated by the query comes from several records whose origins correspond to different collections, each collection should be cited independently, following the preceding model (section 4.b).

  5. Every “USER” acknowledges that the data sets found as open data through these medium may include information and/or content that is the property of third parties. Thus, if the “USER” requires using such information and/or content, he or she shall be obligated to seek Lc/CCUD/CG/003/A/20151013 authorization directly from the owner of the corresponding copyright in accordance with the Federal Copyright Law and any other applicable law on intellectual property.

EXCEPTIONS

  1. “UNAM” is not nor shall it be held liable for the interpretation made and the application given by the “USER” of the results obtained through the use of the information, whereby any decision made based on its interpretation excludes “UNAM” from all liability. Furthermore, “UNAM” is not nor shall it be held liable for differences resulting from numerical precision, rounding or truncation, as well as from any technical or technological changes that may have an impact on such results.
  2. The UNAM OPEN DATA PORTAL UNIVERSITY COLLECTION, as well as all Universityreserves, domain names, logos and trademarks are the property of “UNAM” and their use is exclusive to it. In consequence, their use by any third party lacking express authorization is prohibited.
  3. “UNAM” is the owner of the databases under open access through this medium, which are protected as provided in domestic laws as well as in international agreements and conventions on Intellectual Property, with respect to those databases that, due to the selection or arrangement of their contents, constitute intellectual creations.
  4. Non-authorized use in violation with these “Terms of Free Use” may be sanctioned in accordance with University and other applicable Law.
  5. “UNAM” reserves the right to modify at any time these “Terms of Free Use”.
  6. These “Terms of Free Use” are governed by Mexican law, whereby any dispute related to the interpretation of and compliance with these provisions, as well as to matters not contemplated herein, shall be settled under Mexican jurisdiction, being subject to the jurisdiction of the Federal Tribunals in Mexico City and to the provisions of the Federal Copyright Law, the Federal Civil Code in force and other applicable laws, expressly waiving any right the “USER” may have to preferential jurisdiction by reason of the “USER”’s present or future domicile.

GENERAL INFORMATION

The UNAM OPEN DATA PORTAL UNVERSITY COLLECTIONS is the property of the National Autonomous University of Mexico and is managed by the Coordination of Digital University Collections (Coordinación de Colecciones Universitarias Digitales, CCUD); the domain name http://www.datosabiertos.unam.mx/ and all media allowing direct access to the official site are for the exclusive use by “UNAM”.
